Terms of Service

Please read these Terms of Service (“Terms”) carefully before using Fadr (“we,” “our,” or “us”). By accessing or using our application and related services (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian’s permission to use the Service. By using Fadr, you represent and warrant that you meet these requirements.
2. Account Registration
To access certain features, you may need to create an account. You agree to:
- Provide accurate and complete registration information.
- Keep your login credentials secure and confidential.
- Notify us immediately of any unauthorized use of your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
3. License to Use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes. You may not sublicense, resell, or otherwise transfer your rights to the Service.
4. User Content
You retain ownership of any audio files, recordings, projects, or other content you upload or create within the Service (“User Content”). By submitting User Content, you grant Fadr a non-exclusive, royalty-free, worldwide license to store, process, and display your content solely as necessary to operate and improve the Service.
You represent and warrant that:
- You own or have the necessary rights to your User Content.
- Your User Content does not infringe the intellectual property, privacy, or other rights of any third party.
- Your User Content complies with all applicable laws.
We reserve the right to remove any User Content that violates these Terms or that we find objectionable, at our sole discretion.
5. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Upload or share content that is infringing, defamatory, obscene, harmful, or violates third-party rights.
- Attempt to reverse engineer, decompile, or disassemble any part of the Service.
- Use automated tools, bots, or scrapers to access the Service without our written permission.
- Interfere with or disrupt the integrity or performance of the Service.
- Attempt to gain unauthorized access to any systems or networks connected to the Service.
- Reproduce, resell, or exploit any portion of the Service for commercial purposes without our express consent.
6. Intellectual Property
All rights, title, and interest in and to the Service — including all software, design, trademarks, logos, and content created by Fadr — are and will remain the exclusive property of Fadr. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.
7. Third-Party Services
The Service may integrate with or link to third-party services (e.g., streaming platforms, social media). We are not responsible for the content, terms, or practices of any third-party services, and your use of them is governed by their own terms and privacy policies.
8. Payments and Subscriptions
Certain features of the Service may require payment or a subscription. By subscribing, you agree to pay all applicable fees. All fees are non-refundable unless otherwise stated or required by law. We reserve the right to modify pricing with reasonable notice to you. Failure to pay may result in suspension or termination of access.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FADR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
11. Indemnification
You agree to indemnify, defend, and hold harmless Fadr and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, at our sole discretion. You may terminate your account at any time by contacting us or using the in-app account deletion feature. Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination will do so, including Sections 6, 9, 10, and 11.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall first be addressed through good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration in [Your City, State], except that either party may seek injunctive relief in a court of competent jurisdiction.
14. Changes to These Terms
We reserve the right to update these Terms at any time. When we do, we will revise the effective date at the top of this page and may notify you by email or in-app notification. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
